USCIS Publishes NPRM on Removing Deference to Prior USCIS Determinations of Eligibility
Yesterday, USCIS issued a notice of proposed rulemaking that would end its policy of generally deferring to prior approvals when adjudicating requests to extend a petition for an individual’s employment or stay when the underlying facts remain unchanged. Public comments on the proposed rule are due November 13, 2026.
