USCIS Issues Policy Alerts on Evidence Requirements, RFEs, NOIDs, and DNA Testing

Today, USCIS issued two policy alerts (PA-2026-05 and PA-2026-06) updating Policy Manual guidance. PA-2026-05 updates guidance on evidentiary standards, Requests for Evidence (RFEs), and Notices of Intent to Deny (NOIDs), including allowing officers to deny benefit requests with missing or insufficient initial evidence without first issuing RFEs or NOIDs. PA-2026-06 updates guidance to require officers to suggest DNA testing as an optional form of evidence to establish a claimed genetic relationship when additional evidence is necessary. Feedback on both policy updates is due September 7, 2026.
