District Court Enjoins DHS “Duration of Status” Rule
Yesterday, the U.S. District Court for the District of Massachusetts enjoined implementation of DHS’s final rule eliminating duration of status for F, J, and I nonimmigrant classifications, just one day before the rule was scheduled to take effect. As a result, AILA reports that the new versions of Forms I‑539 and I‑765 will also not take effect today, September 15, as previously announced. The new versions of Forms I‑485, Supplement A, Supplement J, I‑945, and I‑365 remain scheduled to take effect on Friday, September 18.
