DHS Publishes Rule on LPR Eligibility for Certain U.S.-Born Children
Today, DHS published an interim final rule (IFR) in the Federal Register allowing certain children born in the United States to foreign government employees to register as lawful permanent residents, expanding existing regulations for children of foreign diplomatic officers in accordance with Executive Order 14418. The rule is effective September 4, 2026, and applies to children born on or after that date. Comments are due by October 5, 2026. Additionally, DHS announced that it has amended Form I-485 to reflect this change.
