USCIS Announces Final Rule to Expand Provisional Waiver Eligibility


USCIS announced the publication of a final rule that expands eligibility for provisional unlawful presence waivers to all individuals who are statutorily eligible for the unlawful presence waiver and who can establish extreme hardship to a U.S. citizen or lawful permanent resident (LPR) spouse or parent. The rule takes effect on August 29, 2016, on which date USCIS will post an updated version of Form I-601A. In a press statement welcoming the rule’s publication, AILA President William Stock noted that “AILA will continue to work with our 14,000 members and with USCIS to ensure that the program lives up to its intended spirit: to promote family unity and lessen the hardships associated with lengthy and unnecessary separation of American families.”
