USCIS announced that the scope of the February 13, 2018, preliminary injunction against the rescission of DACA is the same as the preliminary injunction issued on January 9, 2018. As explained in USCIS’s previous guidance, the agency is not accepting requests from individuals who have never been granted deferred action under DACA.

DOL announced that it will not begin releasing H-2B temporary labor certifications until February 20, 2018, due to an unprecedented number of applications. As a result of this demand, USCIS has likely received more H-2B nonimmigrant worker petitions than there are H-2B visas available in the second half of FY2018 and may use a lottery to allocate the available visas.
